Abstract

Il saggio muove dalla seguente ipotesi interpretativa: la nascita e lo sviluppo dello stato costituzionale di diritto possono leggersi alla luce della trasformazione del diritto di resistenza, inteso non già come diritto del singolo, o di un gruppo, di resistere all'abuso di potere, quanto come meccanismo istituzionale volto alla protezione “globale” del sistema giuridico inteso nella sua complessità. Meccanismo di “resistenza” destinato, dunque, ad articolarsi di volta in volta in principi ed istituti, quali la separazione dei poteri, la responsabilità politica, la funzione di opposizione, i diritti delle minoranze, la libertà e l'obiezione di coscienza, la libertà di espressione del pensiero, etc. Attraverso la costituzionalizzazione del diritto di resistenza, attuata dalle Rivoluzioni americana e francese, viene a compimento anche la definitiva differenziazione tra rivoluzione e diritto di resistenza: la finalità di tale diritto è infatti la conservazione dell'ordine costituito, dunque un obiettivo non solo profondamente diverso, ma integralmente opposto alla finalità rivoluzionaria
