Il saggio analizza il rapporto tra digitalizzazione e Costituzione, evidenziando il ruolo centrale dei principi costituzionali di buon andamento, imparzialità e trasparenza nell’adozione delle tecnologie digitali. Nel quadro normativo dell’evoluzione dei servizi pubblici, innovati con il CAD e, più di recente, con il PNRR, si interroga sulla capacità dell’attuale ordinamento costituzionale di garantire adeguata tutela ai “nuovi diritti”, frutto del ripensamento dei diritti tradizionali nell’era digitale.
The essay examines the relationship between digitalization and Constitution, highlithing the constitutional principles of efficienty, impartiality and transparency’s central role in the adoption of digital technologies. In the regulatory framework of public services’ evolution – modernized by the CAD and, recently, by the PNRR – it deal with the current constitutional system’s ability to protect “new rights”, wich came out from the rethinking of traditional rights in the digital age.
