Abstract

La discussione sulla introduzione di un salario minimo in Italia oscilla tra i fautori e i detrattori della misura che in ultima analisi riguarda le fonti di determinazione della retribuzione. Fino ad oggi in Italia la fonte di determinazione indiscussa è stata ravvisata nel contratto collettivo di lavoro comparativamente più rappresentativo che sembra aver perso la sua autorevolezza e la sua affidabilità come fonte di determinazione del salario giusto, cioè espressivo dei molti fattori che determinano il valore in concreto del lavoro in un determinato settore produttivo. L'articolo invita a riflettere sulle questioni di fondo che hanno determinato il tramonto di una fase storica in cui il CCNL era in grado di stabilire il salario giusto e sulla necessità di ristabilire un collegamento tra l'art. 36 e l'art. 39 Cost.
