Abstract

Oggetto di studio in questo volume è la lunga trattazione, svolta da Domizio Ulpiano, sul legato testamentario di libri e bibliothecae (capitolo 53 del libro 32 del Digesto). Il testo impone di considerare, nell’indispensabile prospettiva storica, non solo le mutazioni morfologiche e materiali dell’oggetto/libro, ma anche trasformazioni e permanenze del lessico ‘librario’, senza escludere termini attinenti alla sfera della conservazione, come bibliotheca e armarium. Fa da supporto a questa disamina la molteplicità delle fonti esaminate, anche tardoantiche. In sede di commento non mancano interventi sul testo edito dal Mommsen, sia per operare cambiamenti, chiaramente motivati, nell’interpunzione sia per indicare soluzioni più propriamente critico-testuali (pp. 50 e n. 15, 71-74, 89-91). Lo studio coniuga la ricerca filologica con la scienza del libro in un’ottica interdisciplinare all’interno del testo giuridico, del quale pure si colgono ed evidenziano i diversi aspetti: dal metodo speculativo tipico della giurisprudenza romana, che procede fra dialogo con gli antichi maestri ed elaborazione del ius senza mai disattendere le istanze del presente e le sue molteplici tipologie.
