Abstract

La parte V del Codice del consumo intitolata «Associazioni dei consumatori e accesso alla giustizia» prevede due titoli (Titolo I – Le associazioni rappresentative a livello nazionale , e Titolo II – Le azioni inibitorie e l’accesso alla giustizia) che raccolgono le norme in materia di associazioni di consumatori e di accesso alla tutela giurisdizionale. L’impianto normativo del Codice ricalca la legge 30 luglio 1998, n. 281 («Disciplina dei diritti dei consumatori e degli utenti») abrogata dall’art. 146, comma 1, lett. f) del Codice prevedendo: a) la legittimazione ad agire delle associazioni a tutela degli interessi collettivi; b) l’individuazione (attraverso un apposito elenco) delle associazioni dei consumatori e degli utenti maggiormente rappresentative; c) la costituzione di un Consiglio nazionale delle associazioni dei consumatori e degli utenti; d) la previsione di agevolazioni e contributi alle attività delle associazioni.
