Privacy e processo civile

Abstract

Il volume è dedicato allo studio dei rapporti tra privacy e processo civile, in una duplice angolazione: per un verso, la prospettiva “interna” verte sull’esame degli strumenti e delle forme giurisdizionali approntati a presidio del diritto alla protezione dei dati personali, alla luce del d. lgs. n. 196/2003 e della normativa europea di cui al GDPR. In particolare, con riguardo al principio di alternatività delle tutele, sono vagliati gli elementi di complicazione sorti in fase di adeguamento della normativa europea: nel 2018 è stato ridisegnato l’ambito oggettivo della tutela giurisdizionale, mentre il d. lgs. n. 150/2011 aveva da tempo attratto le controversie in materia di protezione dei dati personali sub rito speciale ispirato a quello lavoristico. Per altro verso, la prospettiva di indagine “esterna” è incentrata sulla natura dei conflitti tra privacy e diritti di azione e di difesa, e in specie sugli intrecci tra privacy e istruzione probatoria. Lo studio si chiude con l’analisi dei rapporti tra arbitrato interno e riservatezza, condotta sulla scia degli esiti dell’omologo dibattito in materia di arbitrato commerciale internazionale, imperniato sulla controversa esistenza di un principio di confidentiality connaturato a tutti i procedimenti arbitrali.
