Abstract

Il sicuro crescente rilievo pratico, non meno che sistematico, del foro dell’illecito aquiliano nella moderna economia post-capitalistica globale traluce dalla pronuncia della Corte di Giustizia, appun- tata su uno dei più recenti scandali di frode al mercato e di lesione dei diritti dei consumatori. La sentenza reca una buona novella per i consumatori europei (specie quelli che non possano contare su efficaci forme di tutela giurisdizionale collettiva nei rispettivi Stati membri e debbano risolversi ad azioni giudiziali stand alone). Nel prendere posizione sulla ubicazione delle conseguenze dannose della condotta illecita, in specie dovuta alla installazione di software per eludere i test sulle emissioni, la Corte colloca il locus damnie la giurisdizione internazionale su domande di condanna al risarcimento del danno patrimoniale, presso ciascuno Stato membro in cui sia avvenuto l’acquisto del bene con valore di mercato effettivo largamente inferiore al prezzo di vendita. The growing practical and theoretical importance of tort jurisdiction in post-capitalist global economy is mirrored by the ECJ’s judgment handed down in a damage action arose out of the emissions scandal, affecting the automotive market and consumers’ expectations and rights. The ECJ decision is good news for European consumers (especially for those who cannot rely on actions for collective redress in their Member States and need bring stand-alone damage claims). Required to locate the harmful event out of the installation by the manufacturer of software to defeat environmental controls, the Court held that actual damage occurred where the purchasers bought their cars. Jurisdiction on damage claims, therefore, lies with the courts of each Member state in which the vehicles were purchased at a price higher than their actual market value.
