Il contributo mira ad analizzare la recente proposta di regolamento che istituisce un meccanismo di aggiustamento del carbonio alle frontiere (Carbon Border Adjustment Mechanism o CBAM). Più precisamente, dopo aver approfondito le modalità operative dello strumento, si tenterà di ricostruirne la natura giuridica verificando, nel dettaglio, se lo stesso abbia qualifica fiscale. In base a ciò, si analizzerà se il CBAM, inteso quale onere economico esigibile al momento dell’importazione, sia compatibile con la normativa internazionale in materia di dazi doganali dettata, in primis, dall’organizzazione mondiale per il commercio.
The purpose of this paper is to examine the recent proposal for a regulation establishing a Carbon Border Adjustment Mechanism (CBAM). Specifically, after examining the operational modalities of the instrument, an effort will be made to reconstruct its legal nature by determining whether it has a fiscal status. On this basis, it will be determined if the CBAM, understood as an economic charge payable at the time of importation, is compatible with international regulations on customs duties imposed by the World Trade Organization in particular.
