Abstract

Il contributo, con una particolare attenzione alla casistica giurisprudenziale ed alla prassi applicativa del Garante per la protezione dei dati personali, approfondisce le questioni inerenti alla necessità e proporzionalità dei trattamenti di dati personali svolti mediante sistemi di geolocalizzazione in ambito lavorativo, nonché all’utilizzo dei dati raccolti mediante tali sistemi per fini connessi al rapporto di lavoro ai sensi dell’art. 4, co. 3, l. n. 300 del 1970. Ritenendo non pienamente condivisibili le conclusioni del giudice amministrativo, il contributo evidenzia la necessità di una valutazione della proporzionalità più attenta alle prescrizioni discendenti dai principi applicabili al trattamento dei dati personali.
