Rivedere CILFIT? Riflessioni giuscomparatistiche sulle conclusioni dell’avvocato generale Bobek nella causa Consorzio Italian management

Abstract

In questo saggio si cercherà di contestualizzare e analizzare in maniera critica le conclusioni dell’avvocato generale Bobek al caso Consorzio Italian management, prestando particolare attenzione alle questioni che lo hanno indotto a suggerire alla Corte di giustizia dell’Unione europea un parziale superamento della nota giurisprudenza CILFIT. Nel farlo, divideremo il saggio in quattro parti. Dopo la presente introduzione allo storico caso del 1982, nella seconda parte ripercorreremo le motivazioni che portarono la Corte a CILFIT, per poi, nella terza, esporre le ragioni insite nelle conclusioni dell’avvocato generale Bobek alla luce di considerazioni comparatistiche. Infine, inquadreremo queste conclusioni all’interno di una stagione (lunga) di ripensamento dei pilastri di quello che si potrebbe definire un diritto processuale “complesso”, frutto, cioè, dell’intreccio normativo prodotto, negli anni, dal processo di integrazione europea.
