Abstract

L’analisi si incentra sui delitti di incendio, esaminando le peculiarità normative e le principali questioni interpretative sorte innanzi ai giudici di legittimità e ai giudici costituzionali. Tradizionalmente identifi cati come archetipo dei reati di pericolo, infatti, tali fattispecie costituiscono rilevante espressione della tecnica legislativa che anticipa la tutela penale al fi ne di off rire presidio a beni di carattere collettivo come la pubblica incolumità. All’esame delle fattispecie di cui agli artt. 423 e 424 c.p., si aggiunge lo studio dell’ipotesi di incendio boschivo, introdotto a partire dal 2000, con il conseguente adeguamento dell’ambito di applicazione delle circostanze aggravanti di cui all’art. 425 c.p.
