Sistemas de justicia constitucional

Abstract

El libro critica la dicotomía prevalente político/jurisdiccional y concentrado/difuso utilizada para clasificar los sistemas de justicia constitucional; recuerda que muchos autores habían propuesto tomar en cuenta ulteriores elementos (el bien protegido, la cercanía de los intereses protegidos, la eficacia directa de los pronunciamientos, etc.); sin embargo, sugiere considerar “pertinentes”, ulteriores factores importantes para fines taxonómicos. También niega que, en principio, sea posible clasificar los modelos de justicia constitucional teniendo en consideración un solo elemento. Para formular una propuesta reconstructiva, formula los siguientes apartados: a) moviendo de la crítica de Tusseau a los modelos, en primer lugar la acentúa, no sólo contestando la “pureza” del modelo estadounidense, sino pero metiendo en duda incluso que se pueda considerar en sí un “modelo” difuso; b) mueve la atención, de la clasificación anclada en los modelos, hacia la clasificación anclada en el análisis de los sistemas; c) niega la utilidad de construir clases rígidas, recomendando el uso de clasificaciones débiles, que permitan situar las experiencias en líneas graduadas; d) selecciona algunos elementos importantes para las clasificaciones, reforzando aquellos tradicionales, pero revalorando algunos generalmente dejados en el olvido (especialmente el parámetro y el objeto). El texto sugiere finalmente algunas formas para agrupar en clases dúctiles los sistemas, cruzando las clasificaciones propuestas por separado, para medir la capacidad de condicionamiento de la justicia constitucional en los distintos sistemas.
