La juridificación de la austeridad fiscal en Europa: restricciones presupuestarias dentro de la dinámica federal europea

Abstract

Una de las características que definen al neoliberalismo tal como se ha desarrollado en Europa es la consagración normativa de la idea de austeridad fiscal. De hecho, durante la última crisis económica, tanto en la izquierda como en la derecha europeas proliferaron movimientos y liderazgos euroescépticos que han hecho de la crítica a la austeridad, y a sus negativas consecuencias sobre estados de bienestar nacionales, su principal leitmotiv. Este artículo examina los medios que ha tomado la juridificación de la austeridad fiscal en Europa, desde sus orígenes en la doctrina ordoliberal alemana de postguerra, pasando por su consagración en los tratados de Maastricht y Lisboa, y concluyendo con su rigidización a través de las medidas de recuperación económica negociadas por los ejecutivos nacionales y las autoridades europeas tras la reciente crisis económica. Asimismo, y a fin de ofrecer un punto de referencia con el cual evaluar el sistema europeo de governance económica federal, este artículo explora la dinámica federal cooperativa que se ha desplegado históricamente en los Estados Unidos de Norteamérica, donde las medidas de disciplina presupuestaria consagradas en los distintos estados se han visto complementadas, desde la era del New Deal en adelante, con mecanismos de intervención anticíclica provenientes del nivel federal, que le otorgan a la política fiscal norteamericana una flexibilidad y un pragmatismo del que la política fiscal europea carece

One of the features that characterize neoliberalism as it has developed in Europe is the normative entrenchment of the idea of fiscal austerity. In fact, during the last economic crisis, in both the European Left and the Right proliferated Eurosceptic movements and leaders that have embraced as their main leitmovit the critique of austerity and of its negative consequences over the national welfare states. This article explores the means that the juridification of fiscal austerity in Europe has adopted, from its origins in the postwar German ordoliberal doctrine, through its enshrinement in the Maastricht and Lisbon treaties, up to its tightening through the measures of economic recovery negotiated by national executives and European authorities in the aftermath of the recent economic crisis. Furthermore, in order to offer a point of reference for assessing the European system of federal economic governance, this article probes the cooperative federal dynamic that has unfolded historically in the United States of America, where the measures of budgetary discipline enacted in the various states have been complemented, since the New Deal era, with mechanisms of anticiclic intervention stemming from the federal level, which endow the American fiscal policies a flexibility and a pragmatism that the European fiscal policies lack
