Abstract

Questo manuale tenta di colmare almeno in parte un vuoto nella giuspubblicistica spagnola, associando le forze di studiosi specializzati italiani a quelle di autori spagnoli sensibili ai temi della comparazione, e desiderosi – tutti – di offrire agli studenti e agli studiosi una visione che superi i ristretti confini nazionali e “culturali”. In questa opera, il Diritto europeo e in genere dell’Occidente continua a occupare un posto centrale, per ovvie ragioni collegate alla collocazione geografica, alla storia, a finalità pratiche, alla stessa cultura degli autori. Nondimeno, si apre anche a visioni diverse del Diritto, non solo illustrando le soluzioni positive percorse da ordinamenti come la Cina, il Sudafrica, l’India, ecc., ma soprattutto evidenziando la frattura tra le concezioni filosofico-giuridiche soggiacenti in molte regioni del mondo, rispetto a quelle europee-americane, e la frattura che spesso si determina quando, dell’Occidente, si importa solo la “forma” costituzionale.
