L’influenza della dottrina scientifica sulla giurisprudenza: una ricerca sulla circolazione inter-formanti nel mondo

Abstract

Oggetto dello studio è l’uso della dottrina da parte delle Corti costituzionali o supreme di alcuni Paesi. Esso si propone lo scopo di quantificare tale uso, e altresì l’individuazione delle culture, dei Paesi, delle Università di provenienza, distinte per macro-aree e micro-aree delle citazioni (es.: Diritto civile, Diritto di famiglia, Diritto penale, Diritti e libertà, poteri dello Stato, decentramento, processo costituzionale, etc.), individuazione della sede in cui compare la citazione (maggioranza o dissent, tipo di sentenza, ecc.), analisi dell’argomentazione, formazione dei giudici... Esso è prodromico a una successiva più ampia indagine, con spettro più largo, con base statistica della giurisprudenza ampia e uniforme (salvo deroghe giustificate da alcune peculiarità), ed esposizione dei risultati secondo “griglie” compatte.
