Il pensiero politico dei Bartolo

Abstract

Una compiuta ricostruzione del pensiero politico di Bartolo da Sassoferrato, grande giurista del Trecento, non può limitarsi alla lettura dei tre scritti politici della piena maturità (De Guelphis et Gebellinis; De regimine civitatis, De Tyranno), incentrati sulla specificità della realtà politica italiana, ma deve fare i conti con il contenuto delle opere giuridiche e in particolare dei commenti al Digesto, che ci consente di ricostruire il quadro di riferimento del giurista perugino, un quadro fondato sull'universalismo imperiale e sulla superiore autorità del pontefice. Fondamentale anche l'apporto di opere minori, come alcuni trattati di contenuto giuspubblicistico (il De repraesaliis e il De bannitis, ma non il De electione imperatoris, erroneamente attribuito a Bartolo) o come l'apparato di glosse alle costituzioni Ad reprimendum e Qui sint rebelles dell'imperatore Enrico VII di Lussemburgo, vera e propria monografia sul crimen lesae maiestatis e sul diritto di resistenza.
