Abstract

Alcune recenti sentenze della Corte di cassazione hanno riconosciuto che l’infedeltà coniugale può essere fonte di responsabilità civile. Deve escludersi, tuttavia, ogni automatismo risarcitorio, essendo necessario invece contemperare le diverse posizioni dei coniugi, alla luce dei principi costituzionali e dei diritti fondamentali della persona. La responsabilità civile in famiglia, infatti, solleva il difficile problema del bilanciamento tra la tutela delle libertà fondamentali della persona ed il loro rapporto con la solidarietà in ambito familiare. Some recent rulings by the Supreme Court have recognized that marital infidelity may necessitate compensation for damage against the unfaithful spouse. However, there is no automatic connection between violation of duty of faithfulness and compensation for damage. What is required, instead, is to achieve a fine balance between protecting the rights of the injured party in the marriage and the freedom and autonomy of the individual responsible for any misconduct. Indeed, the issue of civil responsibility within the family raises the tricky problem of reconciling the need to safeguard basic freedom of the individual alongside his /her support role within the family environment.
