Abstract

Desde el periodo de la modernidad a la postmodernidad los discursos sobre la penalidad han experimentado cambios radicales que van desde los fines de inclusion hasta los de exclusion. En la primera e secuda parte se examina la pena y sus fines de inclusion a travers de la superacion de los deficit, desde el siglo XVIII hasta la segunda mitad del siglo XX. Presenta un analis diferencial entre los fines de la pena en el contesto del Estado de bienestar, que promueve intervenciones reduccionistas y abolicionistas de la pena, respecto de los Estados neoliberales, que mas bien privilegian procesos de rencarcelamiento masivo e incapacitacion selectiva para grupos sociales. Un aspecto que muestra este ultimo proceso es el examen que presenta sobre el diferencial punitivo, a traves de la mapa del encarcelamiento, que permite responder a la interrogante: cuanto se castiga el el mundo? En la tercera y cuarta parte, se examina la toeiria clasica de la justificacion del castigo legal, diferenciandolas de las teorias preventivas tecnocraticas de la teorias preventivas ideologicas. En la ultima parte, se aborda por una parte los cambios en la economia politica de la pena a partir de las trasformaciones experimentadas en la penalidad moderna y postmoderna, que el Autor identifica como economia de la parsimonia y economia de la disuasion, y por otra, presenta un examen de las tres orientaciones distintas del Derecho Penal que se advierten en los tiempos recientes: el Derecho Penal Liberal, el derecho Penal de Lucha y el Derecho Penal del Enemigo.
