Il danno da adulterio arriva in Cassazione

Abstract

Le sentenze di Cassazione in commento intervengono - a distanza di pochi mesi l’una dall’altra - sull’infedeltà coniugale, quale possibile fonte di risarcimento del danno. In particolare, l’arresto del settembre del 2011 assume un particolare valore - nell’ormai ampio dibattito sull’illecito endofamiliare – perché il S.C. viene chiamato ad esprimersi non solo sul rapporto tra infedeltà coniugale e risarcimento del danno, ma anche sul rapporto che intercorre tra le vicende matrimoniali e la responsabilità civile. Al riguardo, i giudici di legittimità escludono espressamente un collegamento tra addebito della separazio-ne e responsabilità risarcitoria: non sono rinvenibili, né una norma di diritto positivo, né ragioni di ordine sistematico, che rendano la pronuncia sull’addebito pregiudiziale rispetto alla domanda di risarcimento del danno. Per questa ragione, la mancanza di addebito della separazione non può impedire una separata azione per il risarcimento dei danni cagionati dalla violazione dei doveri nascenti dal matrimonio.
