Il corporate greenwashing come pratica commerciale sleale

Abstract

Emerso in risposta alla crescente domanda di sostenibilità ambientale dei prodotti e delle attività delle imprese, proveniente da consumatori, azionisti e investitori, il corporate greenwashing si è diffuso pervasivamente nel corso degli ultimi tre decenni, assumendo forme sempre più sofisticate e insidiose. Spesso ricondotto, in modo riduttivo, alla formulazione di dichiarazioni ambientali ingannevoli, esso si configura in realtà come una pratica commerciale sleale dalle modalità attuative estremamente variegate. Il volume, muovendo dalla recente adozione della direttiva 2024/825/UE sulla responsabilizzazione dei consumatori per la transizione verde – che integra, tra l’altro, la disciplina generale in materia di pratiche commerciali sleali contenuta nella direttiva 2005/29/CE –, analizza il paradigma alla base della normativa sovranazionale di contrasto al corporate greenwashing, l’assetto di interessi che ne deriva – nella sua tensione tra tutela dei consumatori e protezione dell’ambiente da un lato, e libertà di espressione commerciale e iniziativa economica dall’altro – nonché le molteplici dimensioni della slealtà che questa pratica può assumere, mettendo in evidenza le luci e le ombre della disciplina attuale e delle probabili linee di sviluppo future.
