Il formalismo testamentario

Abstract

L'esigenza di formalismo non è irragionevole né infondata, essendo richiesta fondamentalmente per rendere certezza alla disposizione testamentaria, destinata all’efficacia post mortem del testatore . Tuttavia, la garanzia di certezza, e ancòra di definitività, di ponderatezza e di libertà della manifestazione della volontà testamentaria, nonché di autenticità dell’atto, non può essere eccessiva in guisa di renderla tanto gravosa fino ad impedirla. Il rispetto delle forme non può scadere nel vuoto formalismo, che non tenga conto dei mutamenti sociali, inerenti soprattutto alla funzione attuale del testamento, all’aumento della vita media dell’individuo, al miglioramento del grado di istruzione della popolazione, all’utilizzo di nuove tecnologie. Si impone allora un ripensamento sia soprattutto del concetto di testamento e del suo utilizzo, in rapporto all’atto contrattuale, sia della tassatività delle forme testamentarie, arrivando anche a contestare l’esigenza della necessaria redazione per iscritto.
