Derecho Antidiscriminatorio, Nuevos Valores de Convivencia Y Argumentacion Constitucional

Abstract

La sentenza C-303/06 della Corte di Giustizia ha riconosciuto che la discriminazione per disabilità (Direttiva 2000/78/EC del Consiglio del 27 novembre) può tutelare anche il genitore che si prende cura in via primaria del figlio disabile e subisce, per questo, un trattamento sfavorevole, o molestie, sul lavoro. Questo articolo, analizzando le argomentazioni dell’Avvocato Generale e della Corte, discute le implicazioni della decisione in ordine al raggio di applicazione e al ruolo del principio di non discriminazione; esamina il rapporto tra la decisione e i precedenti emessi dalla Corte di Giustizia nel campo delle nuove cause di discriminazione; si chiede se e in quale misura la decisione possa essere interpretata come un primo riconoscimento del valore del lavoro di cura.
