Abstract

Es posible que el investigador desee reclutar personas con determinadas características genéticas, involucradas o relacionadas en el desarrollo de una determinada enfermedad o con predisposición a ella, con el fin de comprender el mecanismo de la acción de los genes. La relación, que une al investigador y al participante en el estudio científico, nace desde el momento, en el que se perfecciona el acuerdo que regula el funcionamiento del mismo, es decir, desde el momento, en que se proporciona el consentimiento informado por el sujeto participante, adhiriéndose mediante la prestación de la libre determinación su participación al contexto investigador. En el ordenamiento europeo-italiano, la relación, que une al investigador y al participante de la investigación, se rige por un conjunto de normas, de difícil coordinación, en las que se regula, por un lado, el derecho del investigador para llevar a cabo la investigación y, por el otro lado, el derecho del participante a la libre determinación.
