The European criminal investigation order, provided by Directive 2014/41/EU, is the result of a change in perspective with respect to other prior legislative instruments: instead of directly gathering evidence, it allows to conduct an investigation and, subsequently, to gather evidence. This feature represents the innovation and, at the same time, the limit of the legislative instrument in question: it is not coordinated with of the acknowledgement of the power of the attorney to conduct investigations abroad. Without this desirable amendment, possible in occasion of the reception of the Directive, not even this innovation would enable the European criminal investigation order to represent a real breakthrough in the direction of a real parity with the public prosecutor.

L’ordine europeo di indagine penale, disciplinato dalla Direttiva 41/2014/UE, è frutto di un cambio di prospettiva rispetto ad altri strumenti normativi anteriori: invece di acquisire una prova direttamente, consente di svolgere una indagine e, successivamente, di acquisire una prova. In questa caratteristica essenziale risiedono la sua novità e, al contempo, un suo limite: non è coordinato con il riconoscimento al difensore del potere di svolgere le indagini all’estero. Senza questo correttivo, auspicabile in occasione del prossimo recepimento legislativo della direttiva, neppure questa innovazione sembra in grado di segnare un reale progresso sulla strada della ricerca di una effettiva parità con il pubblico ministero.
