Abstract

Il capitolo analizza la responsabilità civile per violazione del Regolamento (UE) 2016/679, con particolare riferimento all’art. 82 GDPR, che riconosce all’interessato il diritto al risarcimento dei danni materiali e immateriali derivanti da un trattamento illecito dei dati personali. Calabrese sostiene che la funzione del risarcimento non è soltanto compensativa, ma anche sistemica, in quanto strumento di attuazione effettiva del diritto fondamentale alla protezione dei dati. Attraverso l’esame della giurisprudenza della Corte di Giustizia, l’autore evidenzia come la perdita di controllo sui dati costituisca di per sé un pregiudizio risarcibile, indipendentemente dalla prova di un danno economico o morale concreto. L’analisi si sofferma inoltre sulle difficoltà di armonizzazione dei criteri di quantificazione del danno nei diversi ordinamenti nazionali e sulla tensione tra responsabilità oggettiva e principio di accountability. In conclusione, Calabrese propone un modello di responsabilità civile europeo ispirato al principio di “rischio privacy”, capace di conciliare tutela della persona e sostenibilità economica del trattamento dei dati.
