Abstract

Il saggio analizza la problematica attuale dei testamenti redatti dalle "persone fragili", ossia soggetti vulnerabili o facilmente condizionabili in ragione dell'età o di malattie, che non ne pregiudicano del tutto la capacità ma che li rendono comunque esposti ad interferenze altrui. Il testamento è il regno dell'arbitrio, come diceva un'illustre voce in dottrina, ma è innegabile il problema di stabilire il confine tra la libertà del testatore che deve essere sempre tutelata e le manipolazioni che possono invece condurre a distribuire la ricchezza post mortem sulla base di criteri in realtà non voluti dall'autore della scheda. Il lavoro considera le posizioni rigide assunte dalla giurisprudenza in merito alla caducabilità del testamento per incapacità o captazione e considera altresì gli auspici di un ammorbidimento del principio di conservazione da parte della dottrina più recente. L'analisi si conclude sottolineando l'importanza di valorizzare gli strumenti di pianificazione successoria inter vivos e constata dunque l'inadeguatezza della regola che presiede al divieto dei patti successori nell'art. 458 c.c.
