La comprensione del diritto

Abstract

Aperta com’è all’integrazione con contributi filosofici e culturali di diversa provenienza, la prospettiva ermeneutica ha saputo realizzare negli ultimi decenni un proficuo dialogo con le varie discipline interpretative. Ma più che come insieme di tesi sostanziali, essa va usata come proposta di metodo dai confini flessibili e come luogo essa stessa di continua mediazione. Raccogliendo i frutti di una lunga riflessione sull’ermeneutica giuridica, intesa come resoconto dell’attività pratica che costituisce il diritto, l’analisi, che si snoda attraverso concetti chiave della proposta ermeneutica, da precomprensione a circolo ermeneutico, da fusione degli orizzonti a traduzione come superamento della barriera delle diversità culturali, tratta i temi della concretizzazione del diritto nella società globale, ripensando originalmente il classico tema delle fonti di diritto e manifestando fiducia nella capacità ermeneutica di ricostruire legami e vincoli tramite l’argomentazione e il ragionamento giuridico.
