Abstract

premessa una ricognizione delle posizioni dottrinali sul valore dell'art. 53, co. 2, Cost., si esamina analiticamente la giurisprudenza in materia desumendone che la Corte cost. non intende negarne il valore normativo, ma difendere la discrezionalità del legislatore nella - doverosa - attuazione di esso. Riconoscere il superamento dei limiti di detta discrezionalità è possibile, p.es. quando un tributo caratterizzante il sistema sia reso proporzionale o regressivo: a tal fine però contano i “criteri” della disciplina e non una valutazione in concreto degli effetti economici del prelievo. Per converso, la progressività deve essere ragionevole e perequata, mentre l’attuale sistema di tassazione reddituale presenta vistose sperequazioni tra varie tipologie di reddito.
