Abstract

Il terzo libro della "Scienza della legislazione" di Gaetano Filangieri, dedicato alla riforma del diritto penale processuale e sostanziale, è quello che da un lato presenta i maggiori caratteri di sistematicità e originalità, dall’altro meglio evidenzia i presupposti giusnaturalistici della filosofia politica dell’illuminista napoletano, benchél'autore faccia ricorso, anche in questa parte dell’opera, al modello organicista per quanto riguarda la giustificazione del potere politico e in specie del diritto di punire. Criticando radicalmente il modello processuale d’antico regime, fondato sul metodo inquisitorio (delazioni segrete, tortura, connubio tra magistratura giudicante e inquirente, posizione di inferiorità della difesa), Filangieri elabora e propone un modello accusatorio puro volto al contenimento della prassi punitiva, caratterizzato dall’accusa privata, dall’oralità e dalla pubblicità, dalla parità tra gli attori del processo, da rigorosi metodi di selezione delle prove, dal ripudio della carcerazione preventiva e della tortura.
