Salario costituzionale, salario minimo legale. Analogie e differenze

Abstract

Se si vuole “prendere sul serio” l’ipotesi di un salario minimo per legge è necessario prima di tutto chiarire la distinzione tra salario proporzionato e sufficiente, il paradigma costituzionale, e salario minimo adeguato, il paradigma sovranazionale. Il salario costituzionale si inserisce in un ordinamento che legittima il conflitto sociale capitale-lavoro e ne riconosce la valenza normativa. Il Costituente, infatti, ha affidato, sebbene non in via esclusiva, alla contrazione collettiva, il compito di fissare l’entità del salario “giusto” idoneo a garantire un’esistenza libera e dignitosa al lavoratore e alla sua famiglia. Nell’ordinamento europeo, la materia salariale, su cui l’Unione non ha competenza diretta, assume rilievo nella misura in cui impatta sul funzionamento pienamente concorrenziale del mercato. L’aspirazione del diritto europeo è, del resto, quella di neutralizzare il conflitto sociale, prefigurando l’inclusione nel mercato di coloro che ne sono esclusi in qualità di consumatori.
