Abstract

L’autore esamina la posizione del Ministro, quale organo costitutivo del Governo ai sensi dell’art. 92 della Costituzione, nel quadro della forma di governo parlamentare. Individua nella personalità poste a capo degli apparati dell’amministrazione regia le figure istituzionali che hanno dato luogo alla figura dei Ministri, e individua nel collegio da essi costituito la scaturigine del Governo come organo distinto dal Capo dello Stato in ragione del rapporto fiduciario con la camera rappresentativa. Dopo aver ricostruito la procedura di formazione del Governo nell’ordinamento repubblicano e avere sottolineato la continuità rispetto alla procedura seguita nell’ordinamento statutario, analizza la duplice posizione dei ministri come componenti del collegio di cui il governo consiste, e come figure apicali dei rispettivi ministeri. Puntualizza le conseguenza concettuali sulla forma di governo connesse alla dipendenza dei Ministri dalla Camera e sottolinea la diversa attitudine unificate che caratterizza il “primo” dei Ministri rispetto a quella già propria del Capo dello Stato. Sostiene, di conseguenza, che il Presidente del Consiglio dirige la politica del Governo nella qualità di capo della maggioranza parlamentare piuttosto che di capo del Governo stesso. [...]
