Immigrazione e competenze

Abstract

L’introduzione al dibattito sul tema “Immigrazione e competenze” dovrebbe iniziare con una considerazione di carattere generale sulla problematica del riparto costituzionale delle competenze tra Stato e Regioni e tenere conto che la logica dell’enumerazione delle materie sembra scontrarsi, in concreto, con lo sviluppo delle politiche pubbliche. Queste richiedono che le regole del riparto (interpretazione delle materie, modo di disciplina, collocazione sistematica delle competenze, ecc.) muovano in direzione della cooperazione tra i diversi livelli di governo. La politica dell’immigrazione ha un immediato rilievo da questo punto di vista. Infatti, sebbene la materia ricada nella competenza esclusiva dello Stato, è evidente come il fenomeno migratorio si ripercuota su una pluralità di ambiti, di competenza statale e regionale; a ciò si aggiunga che la previsione di “forme di coordinamento” tra Stato e Regioni (art. 118, terzo comma, Cost.), ha portato alla costruzione di un complesso sistema in cui, nella continuità tra legislazione statale e regionale, la politica dell’immigrazione ha ormai raggiunto una sua stabilità nell’ordinamento e nell’articolazione dei rapporti tra gli enti di governo. Un valido esempio di collaborazione da considerare in modo propositivo per il complesso delle relazioni tra i due livelli.

The introduction to the debate about “Immigration and competences” should begin with a general consideration about the problems of the constitutional distribution of powers between State and Regions and takes into account that the logic of the enumeration of the subjects seems to collide, in concrete terms, with the development of public policies. These policies request that the rules of distribution (interpretation of subjects, regulation, systematic position of competences, etc.) move to the cooperation between the different levels of government. From this point of view, the immigration policy has an immediate significance. Indeed, although the matter belongs to the exclusive competence of the state, it is evident that the migratory phenomenon affects on a plurality of areas, of state and regional law competence; in addition, the instruction of "forms of coordination" between the State and the Regions (art. 118, terzo comma, Cost.) has led to the construction of a complex system in which, in the continuity between state and regional legislation, the immigration policy has now reached its stability in the organization and articulation of relations between levels of government.
