Abstract

The paper, placed the codes of conduct in the system of the sources of law and defined the nature of professional associations from which they derive, investigates in particular the medical code on the specific topic of information and advertising in the healthcare field through an examination of its relative articles that must be read in the light of the principle of horizontal subsidiarity and which have been affected by some proceedings of the Italian Authority on competition and market and of the administrative Justice.

L’articolo, collocati i codici deontologici nel sistema delle fonti e definita la natura degli ordini professionali da cui promanano, indaga in particolare quello medico sullo specifico tema della informazione e della pubblicità in ambito sanitario attraverso l’esame delle relative disposizioni che vanno lette alla luce del principio di sussidiarietà orizzontale e che sono state interessate da provvedimenti dell’Autorità Garante della concorrenza e del mercato e della giustizia amministrativa.
