The European Commission, in its communication of 8 April 2014, COM (2014) 207 final, proposed to adopt new, stricter rules to regulate the use of civil drones (Remotely-Piloted Aircraft - RPA), emphasizing the areas of security, privacy, data protection, insurance and liability. With regard to the latter, in the absence of a specific discipline, the technical and operational characteristics that distinguish a remotely piloted aircraft (RPA) from the traditional aircraft require a reassessment of the effectiveness of the solutions in terms of civil liability established by the uniform rules. With the support of the various definitions offered by the same rules, it is necessary to determine if there may be a correspondence between the different actors involved in the performance of an unmanned aircraft system (SARP) and the traditional qualifications; in particular, must be carefully evaluated the indications coming from the Rome Convention of 1952 which focuses, on the definition of the Aircraft Operator, the actual aspect rather than the teleological ones.
