Il saggio intende offrire una ricostruzione della intera vicenda che ha portato all'abdicazione del Re Juan Carlos I e alla conseguente successione al trono del primogenito Felipe VI, focalizzandosi sui principali problemi giuridici e politici cui questo fenomeno ha dato luogo nella esperienza costituzionale spagnola. Particolare risalto viene dato all'esame del nuovo trattamento giurisdizionale, c.d. aforamiento, assegnato a Juan Carlos e agli altri membri della famiglia reale da una nuova legge approvata dalla maggioranza di governo. Il saggio si conclude con una riflessione sulla necessità di rinnovamento e modernizzazione della monarchia spagnola per superare l'attuale fase di crisi.
The paper reconstructs the abdication's process of the King Juan Carlos I and the subsequent succession to the Crown of the first-born Felipe VI. It focuses on the main legal and political problems generated by this affair. Particular attention is given to the analysis of the new especial jurisdictional treatment, c.d. aforamiento, assigned to Juan Carlos and other members of the royal family with a new law approved by the government majority. The essay concludes with a reflexion about the need of renovation and modernization of the Spanish monarchy to overcome the current crisis phase
