A PROTEÇÃO DOS CONSUMIDORES NO DIREITO INTERNACIONAL PRIVADO

Abstract

O presente estudo propõe-se a apresentar o tema da proteção internacional dos consumidores em duas importantes e diferentes realidades jurídicas – a da União Européia e a dos Estados Americanos. O trabalho parte de uma análise da discussão européia que levou à aprovação do Regulamento Comunitário para a normatização internacional das obrigações contratuais, a ser adotado em vez da Convenção de Roma de 1980. A seguir, o estudo passa examinar as propostas apresentadas no âmbito da OEA por Canadá, Estados Unidos e Brasil, para a criação da Convenção Interamericana de Direito Internacional Privado (CIDIP VII) sobre a disciplina da proteção dos consumidores entre os países das Américas.

This study aims to present how two important and different legal realities, the European Union and the American States, deal with the international protection of consumers. The work starts with an analysis of the European discussion that led to the Community Regulation on international contractual obligations, to be used instead of the Rome Convention of 1980. Then, the study proceeds to the examination of three proposals of Convention submitted to the OAS by Canada, the United States, and Brazil, for the creation of the Inter-American Convention of Private International Law (CIDIP VII) on the regulation of protection of consumers among the countries of the Americas.
