I cinquant'anni della Carta sociale europea

Abstract

Lo scritto si propone di esaminare l’evoluzione della tutela dei diritti sociali nel Consiglio d’Europa, in occasione del cinquantesimo anniversario della Carta sociale europea, adottata nel 1961, e del quindicesimo anniversario della Carta sociale rivista del 1996. Le predette celebrazioni hanno costituito, infatti, un momento fondamentale per una valutazione critica dello stato di tutela dei diritti sociali, nonché per una riflessione sul futuro della stessa Carta sociale. Dopo una breve parte introduttiva sulla catalogazione dei diritti, lo studio esamina il funzionamento del sistema di garanzia della Carta, soffermando l’attenzione, in particolare, sul meccanismo dei reclami collettivi e la relativa prassi. Indagine quest’ultima che ha consentito di formulare osservazioni sull’effettiva efficacia degli attuali meccanismi di controllo.

The study is devoted to the evolution of the social and economic human rights protection in the Council of Europe, on the occasion of the 50th anniversary of the European Social Charter adopted in 1961 and revised in 1996. In particular the first part of the paper examines the rights guaranteed by the two treaties. The second part focuses on the monitoring procedures. In this latter regard, specific attention is being paid to the reporting procedures and in particular to the collective complaint procedure.
