Abstract

La relazione proposta al Convegno “Commercio e turismo tra federalismo e mercato”, organizzato, lo scorso mese di luglio, dall’INDIS e dal Centro italiano di studi amministrativi “Ignazio Scotto”, prende lo spunto dalla proposta di direttiva europea in materia di diritti dei consumatori per fare il punto sul commercio elettronico nell’ambito di un ampio riesame e miglioramento dell’attuale impalcatura UE dei diritti dei consumatori sia on-line che nei negozi tradizionali. La nuova proposta garantirà ai consumatori, indipendentemente dal paese dell’Unione in cui fanno i loro acquisti, informazioni chiare in materia di prezzi, oneri addizionali e costi, prima che fi rmino un contratto. Ciò rafforzerà la tutela dei consumatori contro le consegne tardive e le mancate consegne, oltre a fi ssare in modo rigoroso su scala europea diritti a vantaggio dei consumatori su tematiche quali i termini per l’esercizio del diritto di recesso, le restituzioni, i rimborsi, la riparazione e le garanzie, nonché le clausole contrattuali vessatorie. La nuova proposta tiene conto inoltre dello sviluppo delle nuove tecnologie e nuovi metodi di vendita, ad esempio il commercio attraverso dispositivi mobili (m-commerce), ovvero le aste on line. SOMMARIO: 1. Premessa. – 2. Linee portanti. – 2.1. Il problema della privacy. – 2.2. Il problema della sicurezza delle transazioni. – 2.3. “Locus regit actum”, ovvero la legge applicabile ai contratti on-line. – 4. De jure condendo: la nuova direttiva comunitaria sui diritti dei consumatori.
