Abstract

La pronuncia della Cass. civ. n. 23/2025 annotata sollecita un ripensamento delle Sezioni Unite in ordine all’ammissibilità dell’azione di riduzione in via surrogatoria da parte dei creditori del legittimario leso o pretermesso, affermata dal precedente di Cass. civ., 20 giugno 2019, n. 19663, e indica come preferibile lo strumento della impugnazione della rinuncia all’eredità ex art. 524 c.c., da applicare in via analogica al caso del mancato esercizio dell’azione di riduzione da parte del legittimario. Il commento, nel mettere a confronto le argomentazioni dei due arresti, condivide la insoddisfazione della ordinanza interlocutoria rispetto alla soluzione in auge, pur ritenendo la proposta ricostruttiva della ordinanza stessa bisognosa di qualche precisazione
