Abstract

Quando nel 1819 il Regno delle Due Sicilie si dotò di un proprio codice penale, il legislatore napoletano, pur mantenendosi sul solco tracciato dalla codificazione francese del 1810, se ne discostò in varie occasioni per pervenire a soluzioni autonome e spesso non prive di un qualche profilo di originalità. Questo è sicuramente il caso dei reati associativi, disciplinati nel code pénal di Napoleone sotto la denominazione di association de malfaiteurs e diversamente ribattezzati nelle Leggi Penali del Codice per lo Regno con il nome di comitiva armata, secondo una definizione più familiare al diritto napoletano dell’età moderna. Partendo con l’individuare le caratteristiche che differenziarono il reato di comitiva armata dall’omologo reato disciplinato dal codice francese, il presente contributo proseguirà evidenziando gli elementi della tradizione giuridica napoletana di Antico Regime che influenzarono la disciplina codicistica di questa fattispecie, per poi soffermarsi successivamente su alcune questioni che stimolarono l’attenzione della dottrina giuspenalistica ottocentesca del Regno. La parte finale sarà invece dedicata alle modifiche apportate a partire dagli anni Venti dell’Ottocento dalla legislazione d’eccezione, volte ad inasprire la disciplina della comitiva armata, al fine di fronteggiare con più vigore la riemersione del fenomeno del brigantaggio.

Although the criminal code enacted in the Kingdom of the Two Sicilies in 1819 was largely based on the Napoleonic code pénal, Neapolitan legislator deviated from it in many instances with different procedures. This is the case with the associative offences defined in French Code as association de malfaiteurs crime, which was also renamed comitiva armata in Sicilian code, according to a definition closer to the Neapolitan legal tradition. This paper attempts to highlight the differences between the French and Neapolitan discipline of this crime, analyze the influence of legal tradition of Ancien Régime on the comitiva armata crime discipline and identify some legal issues that affected the Neapolitan legal doctrine of the nineteenth century. In the end, the paper will focus on the changes made by legislation of exception that, starting from the 1820s, tightened the discipline of the comitiva armata to better deal with banditry emergency.
