Abstract

L’iscrizione al SSN – quale sistema egualitario e finanziato dalle casse dell’erario – si presenta, dunque, come la via concreta di inveramento del diritto alla salute, che l’art. 32, co. 1, Cost. tutela come “fondamentale diritto dell’individuo e interesse della collettività”, preoccupandosi di predisporre strumenti concreti di effettività grazie al connotato sociale del diritto in parola, rappresentati dalle cure gratuite per gli indigenti. L’Italia si dispone fin dall’approvazione del TUI al riconoscimento legislativo del diritto alla salute universale, con un primato che la letteratura scientifica non ha mancato di ricondurre ai valori della cultura giuridica e dell’umanità7, oltre che nel solco dei princìpi costituzionali. Il tema generale dell’effettivo accesso alla tutela del diritto alla salute investe, naturalmente, anche gli stranieri e, tra essi, gli studenti universitari.
