Abstract

Il presente scritto si pone l’obiettivo di realizzare una ricognizione delle ultime giuri- sprudenze che si sono espresse in tema di posizione di garanzia. Da tale prima analisi emergerà come sia entrato ormai in uso il ricorso a categorie il cui impiego spesso costituisce una “cartina tornasole” dell’applicazione, talvolta inconsapevole, della teoria dell’ingerenza. Lo studio, in un’ottica anche comparata, di tale teoria induce nondimeno a ritenere del tutto impraticabile la strada che pretende di assegnare, sul piano della parte generale, rilevanza a tale criterio per fondare la presenza di nuovi soggetti garanti. Diversamente opinando, si giungerebbe al risultato di ridefinire, in nome del criterio dell’ingerenza, alcune categorie di parte speciale in tema di delitti aggravati dall’evento (es. artt. 584 e 586 c.p.), ma anche interi istituti di parte generale (es. artt. 40 cpv., 43, 56 co. 4 c.p.), legittimando la presenza di “garanti omnibus” e trasformando in omissivi reati commissivi in virtù della mera creazione di un nuovo rischio illecito.
