La dura realtà e il “caso Taricco”

Abstract

La sentenza n. 115 del 2018, con la quale la Corte costituzionale si è nuovamente pronunciata sul "caso Taricco", deve essere letta sia nella chiave del bilancio di una vicenda molto problematica, che ha coinvolto la giurisdizione eurounitaria e le giurisdizioni nazionali (costituzionale e ordinaria), sia in quella delle prospettive future. Il peso di questa sentenza non mancherà di farsi sentire almeno su tre piani: quello dell'applicazione dei princìpi costituzionali in materia penale; quello della teoria e della prassi dell'interpretazione; quello dei rapporti fra ordinamento nazionale e ordinamento sovranazionale. Qui, in particolare, si giuocherà la partita più delicata. Ma il nostro giudice costituzionale ha posto alcuni punti fermi, a tutela dei princìpi fondamentali del nostro ordinamento, dei quali si dovrà necessariamente tenere conto.
