Abstract

Il presente lavora analizza la decisione con cui la Corte di giustizia ha esaminato il rinvio pregiudiziale che la Corte costituzionale aveva proposto con l'ordinanza n. 24 del 2017. Nello specifico l’analisi si è concentrata sugli elementi da cui desumere la mancanza di un autentico dialogo non solo tra la Corte costituzionale e la Corte di Lussemburgo, ma anche tra gli altri operatori del sistema di tutela multilivello (Corte di Cassazione e, per aspetti diversi, anche il legislatore europeo). Dopo aver evidenziato le differenze strutturali tra la ricostruzione sistemica della Corte di giustizia e quella della Corte costituzionale, specialmente in ordine al principio di legalità, ci soffermeremo sulla Direttiva n. 2017/1371 del 5 luglio 2017, per poi formulare alcune conclusioni in merito all’apparente dialogo che la vicenda Taricco ha determinato.

This paper analyzes the Taricco II decision delivered by the Court of Justice of the European Union (CJEU) on a reference for a preliminary ruling from of the Italian Constitutional Court (order no. 24 of 2017). Specifically, the analysis focuses on the aspects showing the lack of dialogue between the Constitutional Court and the CJEU, but also among other participants to the multilevel system (Court of Cassation and, for different aspects, also the European legislators). After highlighting the differences between the systemic doctrines affirmed by the CJUE and the Consti-tutional Court, especially concerning the principle of legality, the paper focuses on the Directive (EU) no. 2017/1371 of the European Parliament and of the Council of 5 July 2017. The Author, to conclude, reflects on the “apparent dialogue” characterizing the “Taricco Saga”.
