Liability for defective food products

Abstract

The essay investigates, in light of the recent EU Directive 2024/2853 which repealed EEC Directive 1985/374, the relationship between European legislation on producer liability for damage caused by defective products and European legislation on food safety, offering a reconstruction of the institution when the defective product is a food, highlighting the innovations arising from the recent modification of the legislation on the matter.
