Risvolti assicurativi nell'uso dei droni

Abstract

Il presente contributo si focalizza sui profili assicurativi dell’uso dei droni, facendo riferimento al quadro normativo sovranazionale e nazionale. In tale prospettiva, il tema assicurativo viene affrontato alla luce sia del Regolamento basico (UE) 2018/1139, recante norme comuni nel settore dell’aviazione civile, completato dai Regolamenti (UE), delegato 2019/945 e di esecuzione 2019/947, sia del Regolamento ENAC UAS-IT 2021. Dai Regolamenti europei si evince che, per effettuare un volo con SAPR (Sistema Aeromobile a Pilotaggio Remoto), è necessario avere una copertura assicurativa «adeguata» all’operazione, garantendo così che il traffico di droni nello spazio europeo sia svolto in sicurezza per le persone a terra e in volo. La nuova normativa europea è, infatti, basata sul concetto di rischio dell’operazione. Il Regolamento ENAC, parimenti, richiede quale requisito per condurre operazioni con UAS la stipulata di un’assicurazione concernente la responsabilità verso terzi, adeguata allo scopo e con massimali non inferiori ai parametri minimi di cui alla tabella dell’art. 7 del Regolamento (CE) 785/2004.
