Crisi coniugale e accordo efficiente

Abstract

La molteplicità dell’esperienza che connota le dinamiche familiari, icasticamente designata come transizione dalla “famiglia” alle “famiglie”, rende insoddisfacente un modello di gestione della fase patologica del rapporto affidato, in via esclusiva, all’autorità giudiziaria e amministrato secondo modelli rigidi e indifferenziati. All’esigenza di diversificazione e di adattamento dei rapporti post-matrimoniali alla peculiare fisionomia assunta da una determinata famiglia il legislatore risponde valorizzando il potere di autoregolamentazione dei coniugi quale strumento idoneo a garantire la migliore ponderazione e ricomposizione degli interessi in campo. In questa direzione si muove il d.l. n. 132/2014 che, puntellando l’intesa con opportuni presidi all’integrità e consapevolezza del consenso e, così, coniugando differenti strumenti di autonomia ed eteronomia, realizza un sistema di tutele crescenti che modella la gestione della crisi coniugale secondo il paradigma dell’autonomia privata efficiente.
