Abstract

Si annota la sentenza n. 32188 del 10 dicembre 2019 con la quale la Corte di Cassazione Sezione tributaria ritorna sull'ammissibilità dell'intervento adesivo nel processo tributario giungendo a posizioni del tutto in antitesi con propri precedenti e proponendo conclusioni che potrebbero chiudere il dibattito. L'Autrice, nel rilevare che la pluralità delle parti, situazione processuale che si presenta quando il rapporto giuridico d'imposta sostanziale coinvolge o più soggetti nell'obbligazione tributaria principale, o soggetti titolari di interessi derivanti da posizioni secondarie che si legano all'obbligazione tributaria principale resta ambito estremamente complesso, esamina l'arresto alla luce della necessità di apprestare una concreta ed efficace tutela dei soggetti interessati.
