Taricco iactum est ovvero l’incidenza della saga Taricco nel processo costituente europeo

Abstract

Il presente lavoro analizza gli ultimi sviluppi del dialogo instauratosi fra Corte costituzionale e Corte di Giustizia. L’indagine muove dagli spunti offerti dalla Saga Taricco, vero e proprio banco di prova per il futuro evolversi del diritto costituzionale europeo, richiamando, inoltre, gli ultimi e più importanti arresti giurisprudenziali del panorama europeo. Nello specifico, l’approfondimento qui proposto mira a far emergere lo stato di tensione in atto fra le due Corti, il cui dialogo è eccessivamente condizionato da rapporti di forza. Si mette quindi in evidenza che unicamente un dialogo improntato alla parità ed alla cooperazione fra gli interpreti può raffreddare i termini del conflitto. Allo scopo si prospetta la previsione di un rinvio invertito dalla Corte di Lussemburgo alle Corti Costituzionali e la rielaborazione dell’istituto del rinvio pregiudiziale, unico strumento in grado di favorire un intenso e proficuo rapporto dialogico tra gli attori principali della tutela interlivello dei diritti. Si conclude infine sottolineando come una crescente chiusura tra gli ordinamenti rischia di condizionare il futuro intero dei diritti fondamentali in Italia e in Europa.
