Abstract

Dopo un'introduzione generale l'analisi si incentra sulla individuazione della normativa applicabile ai detriti spaziali (space debris). In tale quadro, viene delimitato il concetto di "space debris" e quindi esaminati i trattati di diritto spaziale al fine di individuare le disposizioni, specie in materia di responsabilità, che possano trovare applicazione on materia. In particolare l'indagine si concentra sul Trattato sulle attività degli Stati in materia di esplorazione ed utilizzazione dello spazio extra-atmosferico compresa la Luna e gli altri corpi celesti (1967), sulla Convenzione relativa ai diritti degli astronauti e i diritti sugli oggetti posti nello spazio extra-atmosferico (1968), sulla Convenzione sulla responsabilità dei danni causati da oggetti spaziali (1972), sulla Convenzione sulla immatricolazione degli oggetti spaziali (1975), sul Trattato sulla Luna e gli altri corpi celesti (1979). Di fronte alla mancanza di una disciplina specifica del fenomeno, si evidenziano le difficoltà di applicare le disposizioni contenute nei suddetti trattati.
